At RegentAtlantic Capital, we collect personal information from clients and prospective clients in order to open accounts and to provide them with wealth management and investment advisory services. In addition, we may collect limited personal information from consumers visiting our website in order to allow us to provide them with additional information about the services that we offer. We do not sell personal information to anyone. We use commercially reasonable efforts to protect the security and confidentiality of the personal information we collect.

In order to conduct our regular business and/or to market our products and services, we may collect non-public personal information from sources such as:

  • Information reported by you on applications or other forms you provide to us, including online forms;
  • Information provided in the course of communications between you and your representatives and members of our staff;
  • Information learned through the execution of transactions on your behalf;
  • Information we collect from you and your other advisors in the process of providing services such as estate planning, income tax planning, risk management, etc.; and
  • Information collected through our website from cookies or web beacons, or other similar devices and techniques.

The categories of information that we collect, and which we may disclose to others as described below, may include, for example, your name, address, phone number, Social Security Number, birthdate and age. In addition, we may collect information about your health, family and marital status as well as information about your employee benefits, income, investments and investment experience.

In the normal course of business we use unaffiliated/third-party service providers to maintain, store, and/or archive records and other data (in paper, electronic or digital form) that include personal information. Examples of such services include document storage, email archival, contact and portfolio management, online client portal and/or aggregation services. In addition, we may be required to share personal client or prospective client information with accountants, tax preparers, attorneys, compliance consultants and insurers as part of the ongoing operation of RegentAtlantic Capital’s business. RegentAtlantic Capital has contractual relationships with these companies, which do not permit them to use this confidential data for any other purpose.

In addition, we may disclose or report personal information in limited circumstances where we believe in good faith that disclosure is required or permitted under law, for example, to cooperate with regulatory authorities such as the Securities and Exchange Commission or other law enforcement authorities.

Our Clients and Prospective Clients

Our relationship with you is our most important asset and we understand that you have entrusted us with your private financial information.

RegentAtlantic Capital will not disclose any non-public personal information about a client or prospective client to any third parties, other than its service providers, agents, representatives, and/or affiliates, or as permitted or required by law. We may disclose client or prospective client information for our everyday business purposes such as those listed below, and to process transactions, maintain accounts, respond to court orders and legal investigations, or report to credit bureaus, or as otherwise permitted by law. Among other things, the law permits RegentAtlantic Capital, as it may be necessary in the course of managing client accounts, to disclose such information for purposes of engaging in securities transactions or account maintenance on behalf of clients, complying with anti-money laundering laws, preparing tax returns and reports for clients, and determining whether a client meets the regulatory or other requirements to make a particular investment. RegentAtlantic Capital will only give client or prospective client non-public personal information to third parties as permitted by law, such as, for example:

  • To investment product administrators, custodians, and other service providers as needed to engage in securities transactions in client accounts;
  • To other service providers as directed by clients or prospective clients, such as accountants, lawyers, etc.;
  • To service providers who may operate on our behalf, or assist us in the technical operation of, information technology systems, including our website, network, or databases;
  • To specified family members (as authorized by law and/or the client); and
  • To third-party software providers, consultants or other service providers as needed to provide requested services.

RegentAtlantic Capital is a fiduciary with respect to all of its clients. If RegentAtlantic Capital reasonably concludes that any of your activities or decisions, or any aspect of your personal situation, is reasonably likely to affect the financial situation or planning of another client of our firm, we may become legally obligated to disclose such information to that client and use such information in advising that client. Such a situation would arise, for example, if a couple who are both clients become separated or divorced, or if one of several business associates, all of whom are clients, makes a decision that he/she does not want to share with his/her associates. These situations can involve difficult questions about our firm’s fiduciary responsibilities, and we will discuss any such issues with you before taking any action that would disclose your private information to another client.

If you decide at some point to either terminate your advisory agreement or become an inactive client, we will continue to adhere to our privacy policies and practices with respect to your non-public information.

Visitors to Our Website

If you complete a form on our website requesting a product or service or seeking more information about RegentAtlantic Capital, the information that you provide may be accessible by service providers that assist in the maintenance and administration of our website and may, in addition, be disclosed to service providers who may help us market products or services to you.

In addition, we collect limited information about the visitors to our website through the use of “cookies” and similar collection activities. We may use the information that we collect to deliver (either directly or through the use of third-party service providers) additional information about RegentAtlantic Capital.
